Bernardine is a law graduate of the University of Malta having obtained her Bachelor of Laws in 2008, followed by a Diploma of Notary Public in 2009 and a Doctor of Laws in 2011. She holds a warrant of a lawyer authorising her to practice in the law courts of Malta. In November 2017 Bernardine further obtained a Master of Arts in Financial Services degree from the University of Malta.
Bernardine has 7 years experience in the financial services sector, starting off at Custom House Global Fund Services Limited (“Custom House”) where she occupied the role of a Legal Officer. At Custom House Bernardine was mainly responsible for the legal and regulatory requirements of funds under administration, acting as company secretary and attending to statutory matters as required, including regulatory compliance as applicable. She was also responsible with providing custody services to funds under administration having a funds of funds strategy, assisting such clients with finalising their subscriptions and/or redemptions in underlying funds and corresponding with the relevant administrators and banks to make the necessary submissions and payments, as appropriate.
Her experience in the compliance sector commenced in April 2013 when she joined Active Services (Malta) Limited as a Compliance Services Executive. This role gained her experience in supervising clients’ activities and assisting with any regulatory matters that might be required of the respective companies. This includes liaising with the MFSA, drafting and reviewing clients’ internal procedures, providing on-going consultancy on existing and upcoming EU Directives/Regulations, Maltese laws, rules and regulations, assisting with the implementation of imminent requirements, holding compliance visits to clients’ offices as part of the compliance monitoring programmes, preparing and presenting compliance reports and attending board meetings. Bernardine also provides compliance support to Active Malta clients as part of the services provided by Active Malta to in-house compliance officers of some of the clients. Her role involves also the provision of support to MLROs which includes the delivery of AML/CFT training, consultancy on the Prevention of Money Laundering Act, Prevention of Money Laundering Regulations and FIAU Implementing Procedures and the holding of on-site visits to review client files from an AML/CFT perspective.
Bernardine has been approved as Compliance Officer by the MFSA on a number of local license holders, ranging from Professional Investor Funds, Company Service Providers, Full Alternative Investment Fund Managers, Alternative Investment Funds, Category 2 Investment Firms, Recognised Incorporate Cell Companies and Fund Administrators. She is also a member of the Malta Association of Compliance Officers.
